Statutory Framework & Judicial Mandate

The Viva-Voce (Personality Test) is the ultimate defining stage of the judicial selection process. Conducted by a panel of sitting High Court Judges, senior judicial administrators, and distinguished jurists, it evaluates whether the candidate possesses the judicial temperament required to preside over a court of law.

The board does not merely test theoretical memory—which has already been examined in the Mains—but assesses emotional composure under stress, impartiality, clarity of spoken thought, intellectual integrity, and rapid legal reasoning.

In several premier states including Delhi (DJS/DHJS), Haryana, and UP, scoring minimum qualifying marks in the Viva-Voce (e.g., 35% to 50%) is mandatory. Failing to secure the viva-voce cutoff results in disqualification regardless of top scores in Mains.

Constitutional Standing

Subordinate judicial officers operate under the direct superintendence of the High Court pursuant to Articles 233, 234 & 235 of the Constitution.
